Fireball BELIEVE Sweepstakes (“Sweepstakes”) Official Rules
No Purchase Necessary. A Purchase Will Not Increase Your Chances of Winning.
Eligibility: The Sweepstakes is open only to legal residents of the United States who are at least twenty-one (21) years old. Employees of Sazerac Company, Inc. and its subsidiaries (“Sponsor”), as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.
Entry Period: The entry period begins on February 15, 2023 when the Sweepstakes Announcement (as defned below) is posted, and ends February 17, 2023 at 3:00 PM Eastern Time or when all ten (10) prizes have been claimed, whichever occurs first (“Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for this Sweepstakes.
How to Enter: On or about February 15, 2023, Sponsor will make a post about the Sweepstakes (“Sweepstakes Announcement”). After viewing the Sweepstakes Announcement, during the Entry Period, potential entrants must send a direct message (“DM”) to Sponsor’s brand Fireball on Twitter at @FireballWhisky with a photo or image of a receipt from a meal that took place on February 14, 2023 or later (the “Entry”). You must be a registered user of Twitter in order to enter the Sweepstakes. Twitter registration is free and can be obtained by logging on to www.twitter.com and following the online instructions to open an account. Creation of a Twitter account requires agreement to additional terms. The use of an agency or any automated system to enter is strictly prohibited, and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion. By entering, you agree that any content you submit may be used on any of the Fireball social channels or Fireball owned and operated sites and you hereby indicate your full agreement to these Official Rules and Sponsor’s decisions regarding the Sweepstakes, which are final and binding. Winning a Prize is contingent upon fulfilling all requirements in these Official Rules.
Sponsor’s Rights to Entries: You do not transfer ownership of your Entry by entering the Sweepstakes. However, by entering, you grant Sponsor, its agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) right and permission to reproduce, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you.
Sweepstakes: The first ten (10) eligible individuals to DM Fireball at @FireballWhisky an image of a receipt from dinner will receive a Prize (as defined below) subject to verification. The odds of receiving a Prize depend on the number of respondeants and the speed at which they respond. Potential winners will be notified via direct message 48 hours after sending their Entry. Potential winners will be required to respond to the notice within forty eight (48) hours in order to win. If a potential winner doesn’t respond within this time, Sponsor may select up to three alternate potential winners.
Prizes: Each winner will receive one-year subscription to Apple TV in the form of an $84 USD Apple e-gift card (the “Prize”). Prizes will be emailed to winners within 21 days of winner verification. A winner is responsible for paying any applicable income taxes and any and all other costs and expenses not listed above. Any Prize details not specified above will be determined by Sponsor in its sole discretion. Prizes may not be transferred and must be accepted as awarded. Sponsor will not replace any lost or stolen prizes or prize components. You may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value. The Prize is subject to, and a winner must abide by, the prize providers’ terms and conditions. Total Approximate Retail Value (“ARV”) of all prizes is $840.00 USD.
General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes; or (b) award the Prizes according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Sweepstakes, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor shall not be deemed proof of receipt of that communication by Sponsor. The Sweepstakes is subject to federal, state, and local laws and regulations and is void in where prohibited.
Release and Limitations of Liability: Except where prohibited, by entering, you agree to release and hold harmless Sponsor, Twitter, Inc., Apple Inc. and their parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any Prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable communications; (e) errors in the administration of the Sweepstakes or the processing of entries; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Privacy and Publicity: Sweepstakes will be collected by Sponsor or its designee and used by Sponsor, its affiliates, designees, agents and marketers for purposes of the proper administration, fulfillment, and promotion of the Sweepstakes as described in these Official Rules and also in accordance with Sponsor’s privacy policy, available HERE.
Disputes: Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Louisville, Kentucky. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Kentucky, without giving effect to any choice of law or conflict of law rules (whether of Kentucky or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Kentucky.

Winners List: To request a winners list, send a self-addressed, stamped envelope to Sazerac Company, Inc. 10101 Linn Station Road, Louisville, KY 40026 Attn: Victoria Zabel-Wirdak. Requests must be received within four (4) weeks of the end of the Sweepstakes Period.
